where a person is treated less favourably than another is, has been or would be treated in a comparable situation on grounds of disability.
where an apparently neutral provision, criterion or practice would put a person having a particular disability at a particular disadvantage compared with other persons. An example of unintentional discrimination is requiring all people who apply for a certain job to sit a test in a particular language, even though that language is not necessary for the job. The test might exclude more people who have a different mother tongue.
